USITC rules Global Bio-chem not violating US Tariff Act

(Infocast News) Referring to its group involvement in the investigation before the United States International Trade Commission (USITC) initiated by Ajinomoto Heartland LLC and Ajinomoto Co., Inc. (the complainants) against its group, Global Bio-chem Technology (00809)
says that the administrative law judge held that the relevant group members' importation of lysine feed products into the US does not violate the US Tariff Act.
On 31 July 2008, the administrative law judge of the commission issued a non-final initial determination and held that the asserted patents are invalid because Ajinomoto failed to disclose the best mode of practising the inventions.
He also ruled that the asserted patents are not enforceable because Ajinomoto committed inequitable conduct in prosecuting the patents. The commission has set 1 December 2008 as the target date for issuing its final determination.
